Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between ProTech Pest Control Inc. ("ProTech," "we," "us," "our") and the business entity or commercial contact ("you," "your," "Customer") using the ProTech website, submitting a request, consenting to SMS, or receiving commercial pest control services from ProTech.

By visiting this website, submitting any form, checking a consent checkbox, or engaging ProTech for service, you represent that: (a) you are at least 18 years old; (b) you are acting on behalf of a business entity with authority to enter into these Terms on that entity's behalf; and (c) you have read and agree to these Terms and to our Privacy Policy.

Website use

You may use the ProTech website to learn about our commercial services, review our service area, and submit a commercial inquiry. In doing so, you agree to:

• Provide accurate, complete, and current business-contact information when submitting any form.
• Use the site only for lawful business purposes and only on behalf of a legitimate commercial facility.
• Not attempt to gain unauthorized access to restricted areas, portals, or back-end systems.
• Not use automated scripts, bots, or scrapers to extract content, submit inquiries, or overwhelm our form endpoints.
• Not upload or transmit content that is unlawful, infringing, malicious, or harmful to the site or other users.

We may restrict or terminate access to the website at our discretion for suspected violation of these Terms or any applicable law.

SMS consent and TCPA disclosures

You acknowledge that:

• You are the authorized user and primary business contact for the phone number you provide.
• Your consent applies to SMS messages sent directly by ProTech as well as by our customer communication service provider acting on our behalf.
• You may opt out of SMS at any time by replying STOP to any message or by emailing stephen@protech-pest.com. Opt-out requests are processed promptly.
• Mobile carriers are not liable for delayed or undelivered messages.
• Opting out of SMS does not terminate your service agreement (if any) or prevent ProTech from contacting you by phone or email for service-related purposes.

Additional SMS-program disclosures, including the short-code or long-code origination number and messaging frequency, are provided within the SMS messages themselves.

Commercial service agreements

These Terms govern use of the website only. Any actual commercial pest control service provided by ProTech is governed by a separate written service agreement or service work order issued to the Customer. That service-specific agreement will contain terms including (but not limited to) scope of services, service frequency, pricing, billing terms, cancellation, site access, and service-documentation deliverables.

In the event of any conflict between these Terms and a specific written service agreement, the specific service agreement controls for the matters it addresses.

Unless agreed in writing, ProTech services are provided on a month-to-month commercial basis with no long-term lock-in. Cancellation policies, notice periods, and invoicing terms for active accounts are set out in your individual service agreement.

Commercial inquiries and inspection requests

When you submit a request for a commercial inspection or quote through this website:

• You are requesting a reply from a ProTech specialist, not entering into a binding service agreement.
• We will respond the same business day (Monday–Friday) to confirm coverage and scope a walkthrough where appropriate.
• An on-site walkthrough and subsequent written plan does not constitute an offer or commitment to enter service until both parties have signed a written service agreement or work order.
• Pricing discussed verbally is an estimate based on information available at that time. Firm pricing is issued in writing after the on-site inspection.
• Response-time language on the site (including "same business day reply" and "within the week walkthrough") describes our typical target response cycle. It does not constitute a guaranteed service level unless expressly written into a service agreement.

Intellectual property

All content on this website — including text, graphics, logos, images, brand elements, and the underlying code and layout — is owned by ProTech Pest Control Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive license to view this website for your business evaluation and engagement purposes. You may not reproduce, republish, distribute, scrape, modify, or commercially exploit any ProTech content without our prior written permission.

"ProTech," "ProTech Pest Control," the ProTech mark, and all associated brand elements are trademarks of ProTech Pest Control Inc. "Aprehend®" is a registered trademark of ConidioTec LLC, referenced here in connection with ProTech's certified application of the Aprehend® biopesticide product.

Indemnification

You agree to indemnify, defend, and hold harmless ProTech, its owners, officers, employees, and service providers from any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any applicable law or regulation, (c) your infringement of any third-party right, or (d) your misuse of information or services obtained through this website.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or use of this website shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction and venue of those courts.

The parties agree to first attempt in good faith to resolve any dispute informally — ordinarily by email or phone with ProTech ownership — before initiating any formal legal proceeding.

Modifications to these Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Last updated" date. Material changes will be clearly flagged. Continued use of the website after an update constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, your remedy is to stop using the website.
